Impending lawsuits

This is going to be amazing to watch unfold. What you all need to keep in mind is that if your state is at will, trash like bny can terminate without reason. However what they legally cannot do is mark you below or terminate for performance if you were on track at mid year and had no issues leading up to that. I know several with lawyers on standby the minute they say terminated due to poor performance . They can also be sued for other reasons you need proof of like discriminatory actions so you have to document everything for proof

112 you didnt read before replying did you? Yes at will means they can without reason. However, do your own research like others are. No they cant fire for performance when you had no prior issues. Thats coming from an attorneys mouth. And if they are at will and dont need a reason why go to the extreme of falsifying someone’s performance? . So no they cant do whatever they want and yea they are discriminating too. Look at wfh employees and what they are doing to them . If you want to know more do your research and make your own calls

Cite the statute that prohibits an employer for firing you for saying you weren't performing. A company can fire you for any reason (or even not reason) except a few such as discrimination, retaliation, trying to unionize.

Sure they can. They did it to me. No issues til year end then below, with no warning. Thank God I got out and left that dump.

@am i said they are at will. However they cannot fire you citing performance and you not have prior issues. They cannot discriminate under a basis either. Thats coming straight from the attorneys mouths. So no they cannot do what they want like they think they can . And forging ratings to terminate isnt at will. Cause they wouldnt need to go to that extreme

They are staffing cuts / layoffs disguised as performance-based cuts. The only saving grace is... if you check a box for BNY diversity... then you may be retained.

I was employed in a department with six consistent low performers. Caused data breaches, missed production targets and failed to cross-train seasonally. Each are still employed by the department. They survived both the 2025 layoffs and hanging in there during the 2026 layoffs.

So yeah. Not performance based.

Sorry to say it but all states in the U.S. except Montana allow at-will employment, meaning employers can terminate employees at any time for any legal reason without facing legal consequences. So BNY can do it’s unethical practices with nearly no consequences. You need a lawyer to attack them with facts.
Especially if you were a long time employee who won any awards and promotions and then got painted as some b.um who couldn’t cut the mustard. It su-ks to have to part with money to pay a lawyer (and no… settlements do NOT mean BNY pays your attorneys) … what’s worse is the time it takes and the fact you deal with lying weasels at BNY now that give you nothing but problems.

@a1 clearing its not truly for performance. But when you lie to employees and say it is with no prior issues then you get your a-s in hot water .

no one is getting termed for performance - check out the winners circle and top performing folks on linked in that were cut.
