Fired Last Week for something Months Ago

Last week, out of the blue my manager said they were firing me for non-compliance with the in-office hybrid model… in 2023. I heard from a coworker there that he read in his teams about people being laid off last week.

A formal warning about being below model was sent to me last month Feb. 2024, which I acknowledged and have since then been on target.

I have always done my job. It seems to me I have been fired during a series of layoffs which occurred and they went back half a year ago as grounds for termination without severance. I know as a positive fact of others who were below model last year which are now still employed, I was even told of the others being below model last year by my manager. If it is grounds for termination why are the individuals being picked and chosen, and why is it happening only many months later? The rest of my team was then told I was not complying with the in-office model to make it sound as if it was a current infraction. Extremely sc-mmy business practice. Has anyone else dealt with this?

Also there were a lot of hard working employees that complied with RTO and got let go. I only wish they fired people earlier and they could saved some of those employees. Good luck finding a job.

There isn’t enough seats for 5 days a week. Matter of fact there’s not enough now. On my floor in PIttsburgh we are constantly getting emails about seating issues and how they’re looking to try to resolve it but yet to do so.

What kind of behavior? They only officially started the warnings and terminations as of January 2024. We were told before then it doesn’t count. We have a hybrid model. So what? Let us enjoy it. There’s no one here to even have a meeting with. It’s nonsense to come in just to have meetings with co-works in other states, Pune, and Poland.

This type of behavior is going to have BNY Mellon switch their policy to five days a week. Come into the office and avoid getting fired or find a remote job. Don’t ruin it for everybody else.

seems to me if you received a formal warning you would have to be RTO off model again and then be Fired... otherwise there is no true formal warning and its just an excuse

There were so many nuances to the RTO, that it was very unclear, and different departments were telling people different things, so to say everybody knew the policy is completely fabricated… Now that they have the dashboard & the fact document out there, I would agree - They finally provided transparency after two years of none.

The people running this company are just not good people and the same people trying to sc--w you out of sub pay, are the same people demanding & getting huge golden parachutes

Everybody knew the RTO policy and knew the consequences about not returning to the office. Good riddance to all that didn’t comply with the RTO policy because they ruined it for the rest of us.

You will not qualify for UE if termination action was deemed to be your fault. Pretty sure BNYM covered their behinds by telling everyone the consequence of not meeting RTO requirements. Good luck suing.

A US employee was told they were terminated & would not get the sub pay. This employee was not given any reason - just told HR Would be in touch, Was never told they were terminated with cause. They have tried to get a hold of HR and get answers for two months now unsuccessfully.

Check they are complying with the termination policy. Were you given due notice, were you given opportunity to correct your behaviour, was your manager aware of your reasons for not coming into the office, etc. Then think if you are being singled out, in which case this is not a valid reason for termination, and you can sue them. Likely as not they'll offer you 2 weeks for every year to shut you up, or maybe 4 weeks if you've not got many years service.

I'm only familiar with european rules where they can't get away with this.

Same thing happened to a colleague in NYC a little while ago from my understanding and we got basically the same explanation though it was from even a prior team and 2023 as well.
