If you're using your SUB payment to go on a long vacation...

be careful whom you share that with. Technically, you are to receive your SUB ONLY while eligible for unemployment. Not looking for a job? Then you are not eligible for unemployment and therefore no SUB payment either. I've no idea how strict the bank is, but technically they hear you're not looking for work, they could cut you off.

I'm not returning to work myself, but I'm so freaked out about losing my SUB that I'm considering not filing for state unemployment just in case they decided to deny me at some point and communicate that to the bank.

This thread is so BNY its unbelievable. Who is tracking IP addresses, BNY or state unemployment office???? Neither have the ability or manpower nor care. I lived 2 states away from BNY and the state that paid unemployment and was out of the country for months. State unemployment pays for 6 months from layoff date, BNY alerts them when you are laid off. You can't defer unemployment until you so choose, you have 6 months from layoff date. Good lord people get your sht together, they tell you this and you have it in writing.

No, but somebody interpreting sub pay rules could certainly consider you to be as ineligible for subpay as you not eligible for unemployment.

SUB CLEARLY states you must me eligible for state unemployment in order to receive SUB. Now, you're not actually required to file for state unemployment in order to receive SUB. All you'll be asked to do is to certify that you're eligible, which of course you'll check that box off.

Also, just in case, it's good practice to use a VPN in general...

I will skip claiming state unemployment for that period. Looks like they are tracking IP address. trying to figure out subpay rules. would subpay rules consider me as not eligible for subpay since I am not eligible for UI

Are you going to be applying for state unemployment? If so, just go on with your life, apply for a job online, just don’t mention you’re out of the country (being out of the country means you’re not able to start work right away), and when asked, certify that you’ve been looking for a job.

Regarding SUB, just certify you’re eligible for state unemployment.

guys please help me out here I really have to travel abroad to take care of my aged mother. This was already planned before I got laid off. My plan was to take 2 weeks work from anywhere thing and take 2 weeks vacation and be out of the country for almost 4.5 weeks.

What are my options?

The policy is clear that if you exhaust state unemployment you’re still entitled to SUB. But until then you MUST qualify for state unemployment otherwise no SUB.

Lol - this isn’t true. If you’re entitled to 50 weeks sub pay and 26 weeks UE - you get your 50 weeks sub pay whether you collect UE or not

I don’t think it works that way. The bank will pay you an “alternative” SUB if from the get go you cannot claim state unemployment. But if you lose state unemployment because the state deems you were not looking for a new job and the bank finds out, they’ll cut off your SUB payments.

Don't listen to any of this. If you were legitimately laid off you are entitled to both SUB and unemployment and it is encouraged. In my state it is checking a box online once a week saying that you had looked for employment. No one is getting rejected from state unemployment insurance unless you have taken a new job, which if so you are no longer entitled to SUB or unemployment. It is set up this way for a reason. BNY cant be sued and can use the state unemployment as their HR department. You think BNY HR is monitoring your location? They can't even get back to job applicants or apparently explain how SUB works. Good luck if you can't figure this out.

I know someone who got let go in September, but the package ends in early March. He hasn’t looked for a job yet because he’s been partying in the Caribbean. My lips are sealed but he should’ve looked earlier…

The secret to scamming the system is let them know you found a job, then immediately retract and say it was an error. You can collect a ton of free unemployment and sub pay that way :)

Concerning sub pay... from the plan docs. If u become ineligible for sub pay bc u became ineligible for unemployment, u will get an "alternate" payment. The "alternate" payment is same as sub except Medicare and social security will be taken out from "alternate"... they are not taken out of sub.

My plan is to apply for unemployment and gamble that I will not become ineligible. Worst case I lose 7.65% ....

Just reviewed the SUB Plan Doc.
You must be eligible for state unemployment to get sub pay. What if some deadbeat unemployment worker decides u are not elligible?

Do less than 7 days vacations, it is still under the job searching limit and you can get SUB payment.
