Severance/ packages at lay offs

For anyone recently laid off, could you comment if you received a package and terms of any severance. As a remote employee, I know I’ll be cut soon enough with RTO.

Absolutely get an attorney. Why do you think HR and legal allow sh---y employees to get away with so much bs when it comes to certain things. They are avoiding getting sued. They may have their own lawyers but if you have a good enough cause to show they had no cause, targeted you , etc. you’ll win. Their lawyers cant cover up them being sh---y and short cutting things to get rid of you

@152+1jw928624 - I am not sure if you are an ill-informed person or just offering some unwanted and impractical advice.

When you are laid off, it is a one-way deal. Take it or leave it. Except you do not want to leave any money on the table. If you do not accept their deal, they have nothing to lose and you have everything to lose. I know of at least one guy who got an attorney involved and try matching that with the thirty employed by BNY (not to forget to the external counsel, who are available on demand). Your leverage is nil. In the end, my friend had to buckle after making his life miserable for several months. It is not worth the aggravation. Just take the money and run. And do not look back.

Every bit of that changed this year. You get a lump sum titled as severance and a lump sum to cover a few months of medical coverage.

@OP standard package is 2weeks for every year. Definitely don’t sign anything u til you speak to an employment attorney first. You’ll be given about 21-22days to review and sign and if you end up negotiating that it will be longer. It’s possible they may (not guaranteed) keep you on payroll while your package is negotiated. If you don’t want to pay an attorney (although I’d suggest you do) for an initial discussion negotiate salary first. Then once you have you number go back and negotiate any terms. If you plan to switch to a spouses insurance or get coverage elsewhere you may be able to negotiate a higher payout if BNY doesn’t have to pay you more benefits. Make sure you press for a lump sum payment so you can file for unemployment after that payment. You can’t get it at the same time as a severance payout. Try to push for the expedited release of any BNY stock as well. Also- don’t be fooled that a layoff transpired- the bank could do that if they want to clean house- especially if there is friction with you and your manger or you’re an older employee.

@m5 I am so sorry to hear this. They are in the midst of doing the same thing to me. 30 years tenure. My boss twisted herself in a pretzel trying to put a positive spin on it. I guess she thinks I’m a fool. I hope you take solace you are in good company as a lot of folks are going through this. It’s despicable but that is where the entirely cruel RV and his toxic leadership is at the moment. I truly believe people get exactly what they give in life.

I know a few different people that were being set up for this and they provided enough documentation to force HR to reverse the fake rating….

I was laid off last year and I rec’d my full pay for several months. I got 2 weeks per year I was working. I heard this year they are doing the same but given as a lump sum payment. If I got a job during my separation package I could no longer get it.

The rule more than 50 miles “as the crow flies”, from the centroid of the zip code of the office you report to, to the centroid of the zip code of your home town. Ask me how I know. I fought HR on this because I was more than 50 miles driving but if you fly OVER THE WATER to Jersey city from me, that’s less than 50 miles so I was denied. Also I know people who were truly more than 50 miles straight line who were denied simply because EC1 said F U no exceptions, and this was for 3 days per week.

Back in 2000, when my previous firm relocated their HQ they made a 35 mile radius for relocation assistance. 35 mile is not the commuting distance but as-the-crow-flies.

Of late that has been increased to 50 miles for a recent Manhattan based firm (Fortune 500) when it decided to get its staff into office - you know which one! My neighbor commutes grudgingly and curses our fortune. He hexed me that I have to do 4 days come September

I don’t know this for a fact, but what I’m hearing in my lob if you’re fully remote but live with a reasonable distance to the office you’re expected to start coming in four days a week in September when we all moved to four days

if you’re not within a reasonable distance, they’re giving you a little more time to decide if you’re going to relocate or consider yourself self terminated - year end.

if you out of nowhere get a partially meets or does not meet for your midyear, know you’re on the chopping block and they’re not planning on giving you severance earned.

You may not get severance if you’re told to come into the office and don’t. Seems harsh if you’ve always been virtual but some managers are going the performance exit route where you leave with nothing.

Is there a legal requirement for BNY to pay severance? If yes, how do I get BNY to pay severance when I am forced to leave due to RTO? I do not live within a reasonable commuting distance to any BNY office.
