Forced Ranking: Suggestions in asking Mgnt if you disagree with Performance Review

Hi, I'm looking for suggestions here. My mid-year review meet expectations and the year -end
review meet expectations, but the overall review ended up Below expectations.
My Mgr agrees that I meet expectations but was given Below expectations as someone
had to be chosen. My challenged my review but was told it was done, though
Mngt agreed it was unfair. And I was told to accept this rating, and finalize
it. Any suggestions?

I never finalized my BE final review because the reasons they put down were so bogus I refused to signoff. I wound up being the one chose of 4 chosen and 2 weeks later I got a package. Truthfully it's the best thing that could have happened to me and I now at peace for a full year till ready to join the workforce again. If you got a package count yourself lucky as this company has gone downhill for quite sometime now. I don't ever want to go back to work for this firm after the years of hard work I put in and all the opportunities I gave up to stay there. Good luck to all and if you really want to know what's best, update your resume and look to get out as soon as humanly possible.

Your year end review should have been completed a month ago. Perhaps that's why you didn't meet expectations.

@2cpk - you are incorrect. You have 45 days from receipt of the Letter Agreement and General Release to consider whether to sign. However, your SUB pay won't being until you sign, so if you need money ASAP, best to get to the notary before your two week period is up, so that you don't miss out.

You should have 21 days to sign the separation package.

Just keep in mind if you get laid off and don’t sign the separation package you forfeit the package. I believe it says in the paperwork that by signing you agree not to take legal action.

Would emphasize the previous point. HR will not help. They are dealing with too many layoffs to care about one in particular and their goal is to minimize the damage and get ready for next round of LO.

Nothing is going to help you here if they decided. HR is useless from every prospective. Start updating your resume and prepare for interview.

I recommend you contact an attorney. Get guidance on how best to proceed. Better to be proactive. Additionally, if you know of others going through the same, get their contact info in case you’re laid off. A lawsuit brought against the company stands a better chance of succeeding the more plaintiffs there are.

Forced ranking systems were all the rage years ago. Now many of the big companies that originally did them stopped doing them (probably from being sued). Thinking in a few years BNYM will end up being sued bigly and forced to pay a huge settlement/fine. And we’ll all end up having a new required class that’s mandated as part of the settlement. ; )

I feel your pain, but unfortunately nothing could be done. It happened to me back in 2014. I was shocked when I got my BE after more than 20 years of service, I didn’t sign it and used a comment line to explain why I didn’t agree, in 6 months they let me go...nobody cares what you do and how you do it any more, old days are gone

When you go to finalize that review, use the comments section to do a write up on why your management is below expectations for the review period. Include everything your management did that fell below the depts expectations. Remember that those comments are seen by higher up management. That’s the whole point. You will most likely get laid off for doing this. But it’s a way to hold your immediate management accountable for what they have done. They could be the next out the door after you are gone

Find a reason to complain to HR for harassment or why you are being singled out or why you are being perceived to be singled out. Use the comments from your manager as evidence that you are on track but there is some other systematic bias. They probably won’t fire you if the case is remotely credible.

Also, If this is happening, think through what you really want.

@OP - Is there still a block on the form for final employee comment? There used to be, but since I was unceremoniously laid off early last year for no reason, I don't know what the form looks like now. If there is a space near the acknowledgement for you to comment, document exactly what you said - that your manager told you that you had fully met expectations but that someone had to be rated BE due to corporate directive. It would be even better if your manager had mentioned this in an email - you could paste your manager's words directly into the comments bloc. If there is no block for employee final comments, document the entire conversation and send it back to your manager in an email. Of course, that might be viewed as a hostile act.

I’m sorry for you, that’s just stinks.
Agree take a copy and document all your conversations for yourself if you go to a lawyer in the future.
Maybe at some point in the future bad press will make them change.
I’ve been at the firm a long time and you can thank all the spoiled brats that demanded they get an exceed every year if their career. Not the whole reason, but part of the reason. Now we are all paying for it.

Honestly, don't think there is anything you can say or do at this point. This forced ranking is company-wide and will be the catalyst for the impending layoffs. My suggestion would be to print out all of your reviews and contact a lawyer if you are laid off. However, since the head of hr is a lawyer, I am sure she knows all of the loopholes to justify layoffs. Nice thanks to all of us who busted our butts last year to quickly adapt to the changes due to Covid. Good luck
