Has anyone been through the medical accommodation process recently?

Can you tell me what to expect? I have the forms completed from two of my doctors.

It’s HIPAA, not HIPPA.

Type in medical accomodation in flagscape...provide the signed survey to doctor...yes you have to fill out hippa document...submit it...when someone gets back to you (2 plus weeks)...stay on top of it with processor assigned...the bank may give push back...the dr will need to put a diagnosis and a time frame when you can go back...

I ve heard of approval to work from home for 4 to 9months for anxiety disorder...i do think management may be more accepting if you are a "good" employee...

@6qxz+1dSn6tLl - It's really hard for a company to fight and/or ignore a federal law. A company may increase the aggravation factor, but if an employee can back up their request with one or more items defined within the ADA, the company can delay but not deny.

@6sgq+1dSn6tLl All good points until you got to the last one. They are pushing very hard now, even on requests that are not Covid-related. Multiple calls to a doctor to try to find ways to get the employee into an office despite the doctor's recommendion for WFH is not indicative of them wanting to provide a reasonable accommodation. My doctor told me she was insulted at being questioned multiple times by HR for a straightforward circumstance that's never been questioned previously.

A few questions and comments:

  • If you have a medical condition that could be justified for WFH under the ADA before Covid, what changed? Why do you require WFH now?
  • If your medical condition was complicated by Covid, make sure it's documented really well.
  • If you are trying to justify WFH via the ADA, but you know that the request is false or misleading, good luck. You might want to evaluate your justification. Why? For every BS WFH request, you make it harder for others that really need WFH to obtain permission.
  • HIPPA does not protect your medical records from being handed to HR. How can HR ensure the claim is valid?
  • HIPPA, ADA, your doctors note, and a lawyer versus BAC. Not a chance.
  • Regarding HIPPA, find a better resource than YouTube. If that is your source, you should sign up for the WebMD physician training. Once you graduate, your WFH problems are solved!
  • Justified health conditions that require WFH as a reasonable accommodation is not hard to prove. Read the ADA.

yes they have revised the forms. you start out with the one on the accommodations page. then they send you another two pages and ask if this is related to covid. then you need to sign a release form of your medical records to your doctor and the bank....
they also now put an expiry date. So even if you get it...it's time boxed...

best thing to do is FIND ANOTHER WFH/HYBRID JOB outside BOFA.

3bfa+1dSn6tLl that used to be the only form. Now they have made it into an elaborate process...they need a release form and additional doc signed forms and they even call the doctor.

They have a huge hard on for the office and will make you go in anyway they can.

Oh I am ready for the fight. And so are my doctors. On the form it actually states to NOT provide a diagnosis. They are so fu---d and they will catch he-l if they even try to reject it.

I guess it depends on the individual situation, but if it were me and they deny a legitimate medical accommodation request then I wouldn’t settle or accept that. Continue to escalate it and do your homework to fully understand what your rights are and what the company’s obligations are. Do not allow the company to discriminate against you.

they've complicated the process now post RTO announcement.
It's not just one form. they will need multiple and calls challenging that diagnoses.

best thing to do is to find a wfh job. There are plenty. This company is putting everything into RTO...and it will fail miserably. Jobs that suk will attract sukers only.

If the Bank cannot provide a reasonable accommodation for a documented condition from your doctor, then you may want to consult with an attorney on what your legal rights are.

I submitted the original request form in August and the revised form in October. I received approval to work from home on Tuesday. It expires on 9.29.2022.

Get ready for weeks of waiting. My doctor submitted mine a month ago. I have yet to hear from HR, but my doctor said HR has called her office multiple times questioning her diagnosis of my condition. They have such a ha---n for RTO that they are placing HR expertise over those who graduated med school. It is insane.
