Stress leave FMLA

So I took FMLA leave due to stress and anxiety from too much work and burnout. I am supposed to return in two weeks but I want to return with a flexible schedule. Not sure if my manager is willing to accommodate me so I am on the fence about resigning if they don’t. I have been with the company for 20 + years. I have never seen in so bad how they care less for us but keep saying we have business needs. What about your employees needs and our health and well being ?

Work stress can be very unequal. On every team there are people who are buried beyond the possibility of succeeding and there are also people who somehow seem to float above and deflect any need to work. This is why they say “If you want something done, give it to the busy guy”.

People in the busy person category eventually have burnout and PTSD. People who simply don’t care are generally well liked, stress free and ineffective. They also have a tendency to rise into middle management.

Since you were out on FMLA for anxiety, which is considered a mental illness, you are also covered under ADA. This means you have a right to accommodations under ADA. Request a WFH accommodation from HR and the company must accommodate you unless it causes "undue hardship." WFH isn't an undue hardship (Exhibit A: the last two years). In your request, be sure to include that the pandemic exacerbates your condition. It also wouldn't hurt to consult with an employment attorney in your state about your situation.

I came back to find some assh0le took my job and I was moved to a more junior role. Good luck. You can but ask and see what they say but based on my experience they will be trying to make you leave rather than fix the problem.
