YSK: Mental Conditions Qualify WFH Medial Accommodations

The crux of the issue when it comes to working for BofA is the recent RTO. BUT…did you know mental illnesses also qualify to have LES review your case to be able to work from home permanently? Anxiety, PTSD, OCD, ED, ADHD, Autism, (just to name a few) qualify as a reason to WFH if your symptoms are exasperated by coming into the office. Get with your doctor first to discuss, if they agree, go to our HR platform to submit a medical accommodations request to WFH and get ready to make a follow up appointment with your Dr. to complete the necessary forms. You don’t even have to notify your manager because, legally, they aren’t entitled to your medical information nor why your new requirements arose. Why we have a 3rd party review the documentation ;)

Also, it doesn’t have to be a doctor to fill out the form - can be therapist (MFT/psyd), podiatrist, dentist, chiropractor etc.

The problem with medical accommodations is the HR rep is forming their own opinion based on what paperwork a doctor is submitting. I’ve seen some ask associates what type of medical condition do you have? That’s not the banks business if my doctor says I have cancer and here are the forms he filled out. No need to question the severity or what form the associate has.

First a a HR consultant reviews your request and forms an opinion. Then they go to your manager and make that recommendation. If you are lucky your manager agrees. If not it goes to HR to decide. If HR does not agree it goes to an attorney.

Some pointers - avoid the word covid - my consultant makes a comment along the lines of well this ones cut and dry not a covid thing.

Have your doctor include your restrictions/ limitations. For me falling is a true risk so that was included.

On the first constant with the HR consulant you will be asked if you’d like to chat about your request. I said yes, and explained out of the gate “I’ve been struggling a very long time since I was X and it’s well documented. Things are getting really bad and I know I could claim disability but I want to remain a productive member of society and be a good role model for my kids.”

When you apply for a med accommodation to wfh, is it the bank that reviews the info? Not really interested in sharing private medical info w my employer.

I did 8 months wfh for mental health...i ended up getting lowest raise and lowest bonus in 8 years..if u use medical accomodation watch out for lower comp regardless of how well u actually do your job

I was granted a WFH for 6 months for mental health. They did give me the run around at first and made it seem like my only option was to take a leave of absence from work. It was almost like they were using scare tactics. But it was approved. There are so many job openings right now, I'm not sure how much longer they can go on like this.

It’s derelict to say everyone should be WFH due to mental health. Those of us whom deal with it, we sometimes sweat just having to talk to another person, we sometimes cringe when another comes to our office space to “hang,” if that’s your attitude, get out of corporate while you can. We ALL deserve to be treated like humans even if others are uncomfortable with the thought eye roll

I thought this was common knowledge. I can confirm personally that this is accurate. I would imagine if you were denied and had sufficient proof of ongoing medications, psychiatry, therapy sessions etc., you could most definitely bring on some type of suit. Not everyone has a doctor willing to fill out the form, and request the full year (especially if you have Kaiser). You may need to seek a private doctor that isn’t held to so many restrictions if you want to request a longer time period. I will definitely continue to request WFH due to my mental health issues, if they don’t like it they can let me go.

There’s a few in my location with medical accommodations but I was told they were going to start denying folks. Wouldn’t that be some type of medical discrimination if they approve others but deny you?

I can confirm it’s true. Your doctor/therapist will just need to submit a two page form (found online). You will have to request your WFH dates, but it could be up to one year and then you will have to renew.
