BNY deny unemployment

Talked with several people from the East Syracuse location over the weekend and found out that they received their severance packages. When they applied for their unemployment they were denied. One of them is going on two and a half months of providing documentation and being told that BNY is the one who is denying the unemployment filing. Anyone else hear this happening?

It’s gets denied until your severance week equivalent ends. If you got 12 weeks severance you can reapply in 12 weeks. If you got 20 weeks severance you can reapply in 20 weeks etc.

Every state differs with respect to treatment of severance.

In NJ severance is not taken into consideration for unemployment - Thus one can get unemployment even if one receives severance
In NY severance offsets unemployment

These two states I know about - may be NY rules have changed. My experience is based on post 9-11 layoffs .. I moved to NJ

NYS Department of Labor website says:

"You will not be eligible for benefits if:

You receive weekly dismissal or severance payments that are greater than the maximum weekly benefit rate; or
Your employer gave you a lump sum payment and the weekly pro-rated amount of the payment is greater than the maximum weekly benefit rate."

"If you are still unemployed when your dismissal or severance pay ends, you should file a claim for benefits. You should do this even if you are not sure if you have enough earnings, or if you filed a claim when you started receiving dismissal or severance pay. We will determine if you are eligible for benefits."

Your separation agreement would have all the details about getting unemployment and a letter to submit if you are denied. If they changed it to severance instead of sub pay you probably can't get unemployment. Make sure you read all the info the bank provided in your agreement. It looks like the bank sc--wed people when they changed things this year. Can't say I am not surprised. Good luck

See, if we had a real HR department, its obligation would still be to provide assistance to these ex employees that it took the responsibility to hire and then fire. Instead, we have a wing of BNY that delights in ‘ch-ump dumping’ instead of human resource assistance. Also, we all saw this coming a mile away back when they changed the SUB to pure lump sum severance. In many states you can’t get both simultaneously. PA may be different but it likely has thresholds that are dedicted from unemployement. Big story- this place continues to ‘skrooo’ people royally.

Two more things.

  1. if any of you are offered severance, upload that to your unemployment submittal to help your case.
  1. If you can, and if you trust your manager (and they are not afraid of repercussions/retaliation) get testimonial from them and your colleagues regarding both the situation and your performance.

But first and foremost please document, document, document and involve an attorney.

This is not true and it is even addressed in the Pennsylvania unemployment manual. You 100% are still eligible for unemployment even with a severance. Everyone should apply regardless.

To the OP. Get an attorney pronto and advise your friends to do the same. If you did not keep copies of all your employment records, reviews etc then request them from hr immediately or consult with attorney on next steps. Do not drop this fight.

Carefully read through your states unrmployment handbook and crosscheck the reasons that unemployment can be denied. Know your rights, know the laws snd fight back.

In the state of PA a severance package is considered your unemployment. The old salary continuation, aka Subpay, was different and with that you could get unemployment. I know many who did.
