Forced Ratings, Unfair Terminations: Building a Case Together

I've spoken with multiple attorneys regarding terminations based on performance clauses as a means to avoid paying severance. There may be grounds for a legal case against BNY if we can demonstrate a pattern—specifically, if individuals are willing to testify that they were part of or witnessed the practice of forced performance ratings.

To keep this thread focused and useful, please only post relevant questions or comments.

Once we have a group of individuals—whether managers who were instructed to force-rate employees, or employees who received “below meets” ratings as a result and were subsequently denied severance—I will share the attorney’s contact details. The law office has requested that someone screen and compile names of those interested in participating.

This just made the news that they are being sued for not giving severances under false pretenses. And I have witnessed first hand being forced to give low ratings despite good performance.

If you’ve been given a bad review but are still in your position, please make the time and effort to save down everything in your employee profile in oracle. Every performance document, comments from peers and management, the scores, all of it. If your title changed at all. Make note of all management changes that may gave taken place, more job duties that were thrown at you, dates for everything.

Be as thorough as possible. Collect it now before they oust you. If you are over 40 then all the better.

If you ARE already terminated, still make the effort to contact them and ASK or demand copies of those things.

forced ratings for sure. You cant have too many exceeds even if you have several who earned it. And if you have an issue person you’re encouraged to rate below. sr mgmt gives a % of headcount to reduce staff by and they dont care if you cant afford to lose anyone. When that happens you navigate toward anyone with attendance issues, performance etc to be selected to meet it .

Only way, is a class action lawsuit where we have managers willing to confirm what these dirtbags are doing. If not, the fight is lost.

We have talked to a law firm in NYC specializing in wrongful termination, they talked to BNY attorneys for over an hr. Cane back and told us that all they can offer is one more month of pay. The attorney said if we want to go forward with the law suit, it may take years. My friend was let go last year with some bs PIP.

If you sign the BNY separation agreement. You agree to the terms of this separation and wave your ability to take legal action against BNY.

Sorry, I just dont see how this works. It would take years with BNY legal fighting every step of the way and anyone cooperating would likely be found in some violation of their employment agreement.
