Called VSap hotline to see if I can take maternity leave ( baby will be taken tomorrow due to preeclampsia) they say if I take any type of leave then I forfeit the right to get the VSP, it su-ks because I wasn’t planning to deliver early. I’m sure my position will be cut as well. I’m so sad. It seems so unfair.

Hi leadership person trying to intimidate and discourage others into NOT taking legal action against your company's nefariously mercurial VSP "terms".
She and others absolutely CAN and SHOULD sue, and when it comes to getting conflicting/untrue information from a VSP rep. And especially in this case, in regard to her prematurely delivered baby and her own health, in addition to her maternity leave and employment itself being in jeopardy, YES SHE DOES have a RIGHT to SUE!
@a4 Nobody is going to get a lawyer for something like VSP. All companies have layoffs and who can afford do hire one? Can you imagine how many lawyers Centene has and do you really think they are scared of any repercussions from the layoffs?

That is not true . You can take FMLA I did and it’s in the FAQs.
@OP Just focus on having and enjoying your new baby! All of this employment stuff will work itself out. Do not stress over it. Having a baby is probably the most special time of a person’s life. It transcends everything else by comparison.

This is a big reason why Centene is in financial trouble. I’ve been here several years and cannot recall one man taking “leave”. On the other hand, the women are always out. FMLA needs to go the way of DEI. Both ruin productivity.
I feel for you and wish you and your baby well. This truly is stressful times for everyone so I can only imagine. Focus on the good news of your newborn and let tomorrow take care of itself. Wish employers had better consideration for their employees and create this level of stress for people.
@OP this is VERY unfair! You can appeal if you get declined. Gosh this is a unique situation and with all the stress that this is all causing that's all you need is to be denied all because you are trying to have your baby. Wishing you all the best ❤️
This is not true. Please take care of you and your baby. These reps do not know what they are talking about. I’m currently on leave and I was told as long as it’s approved it does not disqualify you.
I was on leave and got the message for VSP to accept or decline it, so that doesn’t seem accurate.

Call HR to confirm what the rep. said.
I bet they can't because that sounds sus.
If they say it's true, then insist that they provide you with proof of that caveat in writing. Tell them you want it emailed to you by EOB today.
If it isn't in writing in the original document you signed to apply for the VSP, then you don't have to forfeit anything.
They can't just make up the rules as they go along, and change them at will.
That was an official document you signed in good faith, and they need to honor that.
Also, pregnancy is technically considered in terms of health/corporate coverage to be a temporary disability. Did you get all of that approved yet? And if your pregnancy is requiring the baby to be prematurely delivered, that is another health issue which they have to give you consideration in, because it's not as though you planned on this early delivery happening, and are trying to take "unnecessary" leave or whatever.
What an utterly heinous thing for that hotline rep. to say! Did you get their name?
Girl, you might have not just VSP $$$ coming your way, but even more $$$ from a lawsuit. Right now, focus on your baby and health, of course, but be sure to be documenting all of this!
What?? I called the VSP call center and asked this question as well and was told the exact opposite!! They confirmed I would still be able to take my settlement even though I would be on leave. Wow! I Forsee many many lawsuits being filed.

get a home blood pressure monitor from Amazon and have it delivered tomorrow. it will be important to monitor your blood pressure for the next few weeks (though I'm sure your physician has advised you of that already).
