They are being careful not to commit anything to writing (for obvious reasons), but the writing is clearly on the wall. RV sees this as a key part of his legacy. It's their prerogative, but they have to tread extremely carefully to avoid age discrimination litigation.

This is totally NOT true. I know many employees who have been layed off and later recalled by the bank. Some of them with substantial increases.
So it's saying that to fire older workers they're firing selected younger groups and genX on down??? So you're actually admitting that older workers are NOT targeted. You're sofa king we todd did.

@3xqq, explain it? All you did say they game it. I've seen more than a couple OWPBA reports and they each seem like pretty even distributions age wise.
If you don’t understand it, feel free to ask questions. It’s important to understand this institutionalized discrimination and how it applies to you and your particular demographics. These patterns apply to far more than simply layoffs.

The only thing they could do is hire more younger people than they want so they can fire them along with the older people.
Never forget, her role is to protect the Bank from the employees. This is true of all Human Resources leaders in all companies. Benefits, hiring, promotions, raises… all of those are way down the line.
You’re quite naive and you’ve missed the trick. The first cut is always older high salary Caucasian workers. No exceptions, and it is all based upon age and salary. That’s always the goal of the layoff. The rest of it is gaming the OWPBA Analysis.
The next step is based on performance for the protected groups which are younger… GenX on down, but only the nonproductive employees. The final cut is pure D.E.I. hires, but they really and they must be really poor performers.
This is how the OWPBA Analysis shows that old people are not disproportionately affected. It’s quite the devilish plan. It’s inside baseball…the game within the game.

First, BK doesn't lay people off. They fire/eliminate them with no chance of being called back.
Second, everyone fired gets a copy of the OWPBA Analysis which shows that old people are not disproportionately affected. If you think it shows otherwise, you can sue.
I remember many years there was an older guy (grade probably F or G) in operations who was on the same team as a bunch of mid-20's doing the same kind of work - NAV striking, asset recon, etc. Every quarter, there'd be some layoff, albeit small. Well they chose to let him go.
Ageism is real - it may not be "official", but it's pretty obvious.
Most January layoffs this year, people posted about it on LinkedIn as early retirement.
Sadly, BNYM's system infrastructure is so poor that you need to have those older workers around because they know what's up.. The company can't ki-l these systems overnight because no one at the top can make a strong decision. So they play the long game that eventually results in a deeper hole.
It is a Federal law but age discrimination is never enforced, as I’m sure that you’re well aware.
Ageism is actually easy to use during layoffs. It’s the one attribute where laws are simply not enforced. Add in male and female Caucasian old folks and you can displace them all with impunity. They have been the core of every BNYN layoff since 2007.
I would say ‘older’ as in been with the bank a long time and not necessarily age. For example: legacy BoNY employees. These could range in age from 33 - 70 (assuming they started in 2008 at the age of 18 right before the merge)

They don't eliminate people based on age. They do it based on job class. It was Ks and Ls who were targets in January. Typically, people who are in these job classes are in their 40s or higher.
