You have to prove it was wrongful termination. That will be hard to do. You were apparently fired, not laid off. There had to be SOMETHING that they considered bad on your part. Bank of America gave severance to those who really deserved it. They obviously had good reason to let you go, unfortunately. Before you think about a class action law suit against them, you had better have proof of every little thing. They have exquisite documentation that you don't even know about. So think long and hard before you go off on a lawsuit against a huge corporations like Bank of America. No severance offered means something really derogatory against you.

You're an at will employee - they do not actually need a reason, valid or bogus. If you are a member of a protected class, and you can prove that you were laid off directly as a result of your membership in that class, you have a case. Otherwise, hit the unemployment line like the other 50,000+ employees.

Make friends with your new HR employer and have them probe the hell out of your old employers HR and find the lawsuit. They always talk smack behind everyone’s back. Have someone (agency) Call your old manager and HR for a reference and tape the conversation. Easy lawsuit.

If someone contacts anyone from your old department without your consent then it is invalid and you could have grounds as a lawsuit. This includes the slight of hand application where they ask who did you work for last on the application which is not to be used as an invitation as a reference because you already have submitted references. keep probing the system. You can also pay some agencies on the internet to probe HR for you. Lawsuits keep them honest.

Have some people probe the HR department as a reference checkup and also request your work history record. Anything they attempt to project making you look bad is a lawsuit for defamation of character and more. Probe the hell out of them and someone at the bank will F up and leak something to discriminate. They know what words to say to F you. Find a lawyer.

Unless you have a signed employment contract, in most states it's employment at will. Either the employee or employer can terminate employment at any time without a reason (bogus or not). Companies are not required to provide severance pay unless it is part of an employment contract. Possible exceptions are age discrimination or ADA violations. Again, consult with an attorney. Most will talk to you at no charge to see if you have a case. You can always apply for unemployment while you seek another job.
