BofA management is complicit in exploiting H1B Indian Workers. This impacts workers themselves and the American workers they are replacing

I started managing Indian H1B workers recently. Before I was only an "individual contributor." What I am seeing sickens me. BofA management is complicit in exploiting foreign workers they are bringing to the United States. Here I will briefly explain how it is being done, how it impacts the foreign worker, and why it impacts those American works replaced.

The Indians I work with put in a normal 9 to 5 shift with me every week. The hours might change slightly from day-to-day but in general we are working a 40 hour work week together Monday through Friday. Based on this they enter their 40 hours in and application called fieldglass that I need to approve weekly. They are not allowed to enter more than 40 hours. This is strictly enforced.

Here is where the problem starts. These Indian workers in the US are commonly referred to as "Offshore Coordinators." As it was explained to me they are responsible for coordinating with the "offshore" Indian workers. They provide them with tasks, knowledge transfer, and help with difficult issues that come up on projects. This work normally happens in the evening. If you manage one of these people you will commonly see them online from 10 PM to possibly 1AM in the morning.

Let us be conservative and say that these people are working an additional 10 hours a week on average. Most likely though it is much more than that and I think we all know it. Additionally, if there is a release or maintenance issue that requires non-business hours attention these workers will put in yet more time. There are Friday evenings or Saturdays where they are putting in 8 hours or more easily.

Going back to the fieldglass application where they track hours we see that they are not being paid for this additional time. They are working as hourly contractors and not being compensated for this additional work at all. It is exploitive in nature. It is criminal in truth. It should not be allowed to continue.

I work with these Indians every day. I have grown to respect them as people. They are good people and just like you and me just trying to make their way in the world. They have families and have the education and experience to do a good job. The deserve to be compensated. However, they are being exploited because they think they need to work these additional hours for free in order to work here in the United States. It sickens me and it should sicken you as well. Slavery and indentured servitude ended here in America in 1865.

This impacts the American worker because they will not work for free. I work with the occasional American contractor. They are told that they are only allowed to work a 40 hour week and that is indeed all the time they put in. They would not consider work more hours for free because that is just not done. They are hourly contractors and they expect to be paid for their efforts.

Since Americans cannot be exploited I think the BofA managers lean toward Indian workers they can exploit instead of hiring an American. The Indians is already being paid a lower hourly rate than an American. With these hourss of free work an Indian will put in an American work has little to no chance of competing. It is clearly an unfair advantage. It needs to stop.

(Author Note: I have been tossing and turning all night thinking about writing this and letting others know my thoughts. Please let me know your thoughts. This is really bothering me and I do not know where else I can take this to get this practice stopped. If you have a suggestion please share that as well.)

The Indian Rupee currency is way too low thus being manipulated by the Indian Govt to the USA's disadvantage. We need someone to fight for the USA!!!

They sure are! More and more are outsourcing is being sent over to India and others are being brought over via the Consulting agencies at a discount, all in an effort to exploit the strong dollar and maximize the currency exchange rate difference.

The Indian currency [rupee] is artificially very low against the US dollar (~50%), but no one is doing anything about that...

Stop with your unnecessary guilt. You are not their messiah, they don't even need one. As a stockholder, suggest stop chatting with them about their personal lives, the tales one can spin....

Before you lose too much sleep visit the campus in NJ and see how many of them are walking the campus - the perimeter, the main 'street', the parking garages- and how many are sitting outside at the tables and benches throughout the day. In reality I doubt you are seeing 8 hours of productive, work related time while you are together so i wouldnt worry about it. Plus many of us are working 45 - 50 hours a week as well (on salary).

If you believe they are actually working from 10:00pm to 1:00am in the morning then dream on! Because of the time difference they are probably chatting with friends and relatives in India. They may do a little work at those times but these liars most likely seldom do it consistently or anything of any real value. This is part of the Indian lying cache like their bloated, fake resumes etc... Don't get involved in this, it is culture you probably don't understand and will always be the outsider ie "not one of them". They will bury you eventually so look after yourself!

You could create an anonymous e-mail account (hotmail etc) and send your description of what is happening Brian M. and his directs directly. BM reads email and may take swift action especially if there is reason to believe the media may pick it up or the Bank could face fines. Sign the email as a concerned employee who would like to remain anonymous but will consider reporting the issue to regulators if action is not taken. If you want to make sure nobody knows who you are, go through a 3rd party VPN service to mask your IP.

This is a weird/complex problem... very related to globalization, regular run-of-the-mill exploitation, and erosion of affirmative action remedies for African-Americans. I will stay away from making nativist statements. But first, being a person w/enslaved ancestors, it makes me uncomfortable to see the term "slavery" used loosely. It's not the same thing as the violent, forced labor millions in this hemisphere were subjected to... To the original writer, you are very intelligent, you know what you need to do you really don't need others from this site giving you advice, there are other like managers you can speak to in confidence before you do what you already know you should do, I'm sure you also need your job but don't let that deter you from doing the right thing

Those Indians do have a choice! They can stay in India and make their own success in their own country, they do not have to come for hand-outs in the USA, they bring nothing here and expect wonders. The joy of making profits from currency disparities actually does have a price!

For you, you can start to understand what Trump stands for and think about the changes he will make if you vote for him. Otherwise, learn to trade currencies and you too can start to make money just like the banks.

While in MyWork, I'm sure I put in an average of 60 to 80 hours a week, salaried, no overtime.

Pretty standard unless you araremployed in California.

As one who has contracted for both BofA and Wells, the practice you illuminate is not indigenous to the East Indians who visa in. Indentured servitude is the business model which has gained blinding success over the last decade, and applies to contractors across the board. Employment law, as with tax law, is very difficult to navigate, and financial institutions are well versed in how to manipulate it. Record keeping based on policy is paramount, providing the bank with supporting documentation that it is within the legal parameters. The remainder of the quandary rests on ethics, and morality cannot be legislated.

What do you consider underpaid and how are the able to afford to live here? Charlotte and Plano are not cheap when it comes to housing etc. We have plenty of American folks working for the bank that make next to nothing, so it makes no sense to me that they'd bring offshore talent and replace American workers for the same money.
