You have to be both voted on and terminated and you have s limited amount of time to postmark the completed filled signed paperwork which you have to request from Tms to regional noting the policy you were fired for and how it was not applied improperly. The regional Tms ec then decides if it will go to fair hearing. The hearing is heard by a group who does not know you plus you get to invite one team member to speak for you. Make sure you have all conversations dates time names and any witnesses to conversations, as well as that info when t was not applied to others. Any dates times and topics of when you were called or texted about work on your personal cell phone. Since you have been fired at this point you have nothing to loose, or f it is approved you get back pay too

As someone who's been with this company for a decade with 5 years as a team leader I can say that it depends on the situation as well as the position, but only for the fact that as team leaders you are taught to DOCUMENT EVERYTHING. If there's an issue with a fellow team member you better have emails, logged conversations with leadership, and recaps to yourself and/or your associates. This can be your saving grace at these things. As a regular team member who goes into this job starry eyed this is the last thing you think of. So I've seen regular team members waste time and energy on these things simply because they couldn't bring their own burden of proof regardless if they deserved an outcome in their favor or not. I see team leaders and above use these and win more often because they can provide tangible evidence via a paper trail, even if they were nepotistic AF. Proceed with caution unless you have the documentation skills of a legal expert.
