Thread regarding Bank of America layoffs

Same story once again

From what I am seeing, once more the hardest hit group are employees in their late forties and fifties.

How long are we going to allow this blatant age discrimination to continue? I don't care about the reasoning behind it, this should be and IS illegal.

Is there really nothing we can do about this?

Contact the nearest EEOC ( Equal Employment Opportunity Commission) regarding the laws and protected age group (40 - 65). The law is ADEA.

Young Indians are the group of choice, you can see them everywhere! Mostly in IT supporting the Myth that Indians are good at IT for some reason. Whatever that reason WAS, it definitely no longer applies, they are certainly no better than anyone else, in most cases the reverse is true especially at the management level.

Does your area have alot of younger people? In some areas its mostly older, so if they have to lay people off then there pretty much isn't any other option. Hard to replace people that have been with the company a long time, that experience takes time to learn.

You should send Brian Moynihan a letter first. He will definitely reply. If you are not satisfied, then file a complaint with the EEOC.

Does anyone know who would you engage to report this discrimination - ageism?

They take that pretty seriously and review all layoffs over a certain age (40 IIRC) to ensure it is not disproportionate / illegal /etc. Because these layoffs were focused on span of control, they probably did disproportionately target older employees (who are more likely to be managers or team leads).

Layoffs s---, but there is no reason to suspect systemic age bias, and there are in fact controls to detect latent bias by the individuals making team level decisions.

I think the best way to fight this is by strength, competency and moral high ground.

BofA is beneath our time and attention - we should start a business, join a better company, etc, and eventually aim to drive them out of the market.

It is, however, tempting to get all united and publicly shame them:-)

You can refuse to sign your severance paperwork and instead hire a lawyer. People are probably too dependent on severance to really do this. I am not the breadwinner in the family so if it happens to me I would probably fight.
