Manager-Initiated SUB Request

Have any ‘managers’ who lost their direct-reports as part of the spans and layers implementation argued for and then received SUB? In addition to job elimination and job discontinuation, there is also a clause in the plan that allows for SUB as part of a “reduction in force, business restructuring, or other similar condition.”

Also, the BNYM SUB Plan allows you to initiate a claim direct with the Plan Manager if you feel you qualify to receive benefits but your manager chooses to not submit you. Has anybody done that, and what were the results?

SUB stands for supplemental unemployment benefits. You don’t receive unless you are unemployed. Losing direct reports but still being employed by the company is not a qualifying event. The language you cite is referencing various flavors of lay-off terminology (elimination of specific position or headcount vs a general reduction in force across the board vs a restructuring that results in something like an entire department going away.

Correct me if I am wrong, but here is what I think is being said: If spans/layers removed a manager's direct reports, they are not really a manager anymore and under the plan it allows them to qualify for sub benefits? I think the second half of the comments is that the manager can proactively request sub from the plan manager - without hoping and praying that the company lays them off at the next round of layoffs. Anybody agree? Disagree?

I'm a manager at BNY Mellon. I read this your question 5 times and honestly I still don't understand what you are asking. Hopefully a smarter BNY manager answers this because I would love to not only figure out what you are asking but see the answer!
