FMLA Impact on RIF Notification?

How does being on leave impact notification if you are RIFed? Do they wait until you get back to inform you? Does the clock start while during leave or after you return to work?

This question is specifically in regards to maternity leave, so I have a firm return to work date.

I was technically a part of the November layoffs and I knew I was getting laid off while on maternity leave because my director called me when he wasn’t supposed too , so I used up the rest of my VPL and officially didn’t get laid off until my first day back from leave , that gave me an extra 60 days because of the state I was in. It su-ked but my supervisor also didn’t make me work for those two months till I was officially off the books.

Yes you can be included in a layoff while absent from work, but the NOTICE may not be communicated until you return and NOTICE PERIOD will not begin clocking until you return.

Depends on if your leave started before you were given notice. Certain types of protected leave including STD and VPL will be let to ride fully until your return to work (or conversion to LTD).

I do not think unpaid FMLA alone or other types of leave receive the same treatment. If they are, please share.

No they don’t have to wait. I had 2 coworkers clipped while on leave during the last cut.

@bt Verizon waits until the next layoff vs terming someone so it seems unrelated. But this has occurred to so many people on so many different teams in so many different orgs that it has to be unwritten policy at the executive level to penalize workers who use their leave benefits.

They can’t fire you on FMLA. But I do feel like those that took maternity leave, are let go sometime after their return. That’s what happened to me

You are allowed to serve out your full leave as long as your leave started before your layoff notification.

This includes if you’re awaiting sedgwick’s decision. If your first day missed (awaiting certification) is before your notification date, you will be allowed to stay on payroll through any FMLA, STD (even convert to LTD if disability extends that long).

When you return you will still receive your full notice period before actually leaving payroll.

Yes, they have to wait until you are after FMLA to notify you. Don’t you see in NJ and have 90 day roll off period after notification the clock will start after you return.

You can also check with you manager during fmla if you wanna know sooner - I’m sure they will give you heads up
